Waiver of Liability

I for myself, my child, my heirs, personal representative and assigns forever release, remise, discharge and agree to save and hold harmless and indemnify MEKA Catamaran, its members, directors, officers, agents, employees, volunteers and owners and lessees of premises, upon which activities are held (reference to activities described in MEKA Catamaran Sales Package), the participants therein and the owners and lessees of all race equipment used therein (herein referred to as “the Releasees”) of and from any and all liability, claims, actions, and possible causes of actions whatsoever, including negligence of any of the foregoing that may accrue to me, my child, my heirs, and personal representatives and assigns from every and any loss, damage and injury (including death) that may be sustained to my child and property while in, about, and enroute into and out of premises and property upon which the activities are held.

Assumptions of Risk

I am aware that the activities involve potentially hazardous conditions which may include, among other things, maneuvering a boat on deep waters, strong winds and high waves, sudden unexpected immersion in deep waters and collision with other watercraft or stationary objects such as docks, pilings, piers and buoys. With knowledge of the dangers involved, including but not limited to accidental drowning, injuries from slipping or falling, and potential harm from marine life, I declare that I am physically fit to engage in these activities and have no medical conditions that would be exacerbated by them. I voluntarily ask that my child be allowed to take part in the activities.

I accept any and all risks to myself and my child of injury, death and property damage arising from participation in the activities and the use of facilities and property of MEKA Catamaran, specifically including any injury or damage caused by the negligence of any of the Releasees.

Safety Measurement

I hereby agree to adhere to all safety instructions, including but not limited to regulations, guidelines, emergency procedures, and other descriptions of a similar nature as provided by MEKA Catamaran and its personnel. This includes, but is not limited to, the requirement to wear life jackets, remain seated while the vessel is in motion, and comply with other specific safety practices pertinent to the activities in which I am engaged. I acknowledge that in the event of an emergency, staff members will provide necessary assistance and, if deemed appropriate, will contact emergency services.

Marine National Park

In accordance with the Thai Marine National Park Rules & Regulations, I hereby acknowledge and agree to comply with the guidelines for entry into Hat Nopparat Thara – Phi Phi Islands National Park, Krabi Province, under the jurisdiction of the Department of National Parks, Wildlife and Plant Conservation. I understand that swimming within or near the coral reef protection areas of the park, including zones adjacent to mooring buoys and fish egg buoys, is strictly prohibited as mandated by Thai Government regulations. This policy is part of a broader initiative aimed at safeguarding the marine ecosystem, particularly around Maya Bay and the surrounding restricted zones in Krabi and the southern provinces of Thailand, with the goal of promoting biodiversity. I recognize that any violations of these regulations will result in a fine, as stipulated under the National Park Act of 2019, amounting to 5,000 Thai Baht per individual.

Use of Personal Data for Media and Marketing Purposes

By signing this consent form, I grant MEKA Catamaran the right to collect, process, and use my personal data, including but not limited to my name, image, voice, and other identifying information, for the purposes of media and marketing. This may include, but is not limited to, promotional materials, advertisements, social media content, and other marketing communications. I understand that my personal data may be used in various media formats and may be distributed or published publicly. I acknowledge that I have the right to withdraw my consent at any time by
providing written notice to MEKA Catamaran, and that such withdrawal will not affect the lawfulness of the processing prior to the withdrawal.

Indemnity Agreement

I agree to indemnify and hold releasees harmless from any loss, liability, damage or cost including reasonable attorney’s fees they may sustain or incur due or relating to my child’s participation in the activities and use of the property and facilities of MEKA Catamaran, specifically including any such loss, liability, damage or cost resulting from the negligence or other action, of the Releasees.

I have thoroughly reviewed and fully comprehend the contents of this document. I am aware that this consent form contains Waiver of Liability, Assumption of Risk, Safety Measurement, Marine National Park, Use of Personal Data for Media and Marketing Purposes and Indemnity Agreement in which I agree to indemnify the Releasees. I am signing this form voluntarily and of my own free will.
